When this service is needed
A pre-litigation specialist opinion is commissioned when a dispute can still be resolved without a court-appointed expert examination. It is useful before submitting a formal claim, before negotiations with a contractor, developer or property management company, and as an attachment to a statement of claim.
The key purpose of this document is to show the property's actual condition, list defects, describe their nature and explain which specific demands the client may subsequently make.
Questions commonly addressed
- Which defects already exist and how should they be described correctly?
- Which documents will support the client's position at an early stage?
- Can a technical basis be established for a formal claim or lawsuit?
- Does the cost of remedying defects need to be assessed now?
Practical situations
- the contractor refused to rectify the apartment renovation voluntarily
- construction defects were discovered after acceptance of a house or office
What you receive
The client receives a document convenient for practical use: a list of issues, references to source materials and a clear structure. It can readily be attached to a formal claim, sent to the other party and used during a consultation with a lawyer.
Photographs are used as thematic illustrations and do not relate to a specific client's case.
